To hire a foreigner officially, an employer in Ukraine — a company or sole proprietor — usually needs a permit to employ a foreign national. The permit is obtained by the employer, not the employee (Law of Ukraine "On Employment of the Population", Articles 42–42⁹).
Who does not need a permit
- foreigners with a permanent residence permit;
- refugees and persons granted complementary or temporary protection;
- accredited staff of foreign media and representative offices;
- participants in international technical assistance projects;
- clergy invited by religious organisations;
- other categories set by law (special rules apply, for example, to Polish citizens).
How to get the permit
- The employer submits to the employment centre an application, a copy of the foreigner's passport with translation, a photo and a draft employment contract.
- The decision is taken within a few working days; the permit is issued for up to three years, and the fee depends on its term.
- Based on the permit, the foreigner obtains a temporary residence permit.
Working without a permit leads to a fine for the employer and may be grounds for the foreigner's forced return.
