Supreme Court: a reply to an attorney’s request does not extend the deadline for going to court

In its ruling of 25 June 2026 in case No. 520/25416/25, the Supreme Court of Ukraine considered a dispute in which the claimant did not ask for details of a calculation for more than five months, then sent an attorney’s request and filed a lawsuit. The Ukrainian National Bar Association published a review of the ruling on 14 July 2026.

The court’s conclusions:

• the three-month time limit for going to court runs from the day the payment document was received (in this case, a pay certificate), not from the day of the reply to the attorney’s request;

• delay in taking steps to prepare a lawsuit is taken into account by the court;

• because the claimant was inactive for a long time, the court held that the deadline had been missed.
